為什麼?
一 名 廚 師 今 年 五 月 在 網 站 「 點 點 紅 」 拍 賣 兩 張 「 許 冠 傑 繼 續 微 笑 會 歌 神 」 演 唱 會 門 票 ， 卻 以 女 兒 帳 戶 登 入 網 站 暗 中 參 與 競 投 及 「 托 價 」 ， 最 終 得 以 八 百 零 五 元 的 價 錢 成 交 。 該 廚 師 昨 在 九 龍 城 法 院 承 認 一 項 欺 詐 罪 ， 裁 判 官 指 所 有 參 與 網 上 商 業 活 動 人 士 均 需 極 高 誠 信 ， 但 被 告 有 計 劃 犯 案 ， 須 判 入 獄 四 個 月 以 儆 效 尤 ， 為 首 宗 網 上 炒 賣 演 唱 會 門 票 詐 騙 案 被 判 監 。
一直不明白為什麼買了一張戲票或演唱會票之後把它轉售(所謂炒黃牛)是犯法；也不明白為什麼用一個比較人為的方法在拍賣中讓叫價推至較高水平，讓最肯出高價的買家勝出是犯法；更不明白為什麼你情我願的買賣要坐牢四個月。我還記得某某明星藏毒只是罰款千多元。
我也不怕說，我試過因為突然有事，把演唱會票售予一個不相識的人，我可取回金錢，他可得到門票，按常理說是大家高興，這竟是犯罪行為？

That's an outdated law. The underlying concept is you have only purchased the right to 'watch' the concert, but not the right to derive income or transfer this right. I conjecture that this law is not effectively enforced (people sell tickets of Real Madrid just outside the HK stadium. and it seems that there is no way for the police to prove whether the buyers and sellers know each other - ' i ask my friend to buy it' or they just have buy-sell relationship)
Well, artificial bidding is no different from selling fake medicines in the street. That's cheating - it distorts the signal of price.
Well...i think the main point in this case is cheating, though the underlying law is the prohibition of resell of tickets.

我明白「托價」是不誠實（可以說是有點像詐騙）的行為，不過我想不至於等於賣假藥吧。我同意這樣做是會扭曲價格訊息，不過這個跟那些在街邊推銷洗油煙機水的人找人「做媒」的人差不多。事實上在樓宇買賣過程中，經紀多會說「仲有一個客好有興趣，佢出得高過你，好快ｄ決定喇。」，托價也不是新奇事物啦。
不過，法律要彰顯當時的社會價值觀，如果社會不能接受托價的話，那就焗住遵守吧。
但判四個月監會不會重了些? 他的欺騙行為只涉及$850....
